TERMS & CONDITIONS FOR BUYERS

These Terms and Conditions (“Terms”) are the terms and conditions on which Rewind Vintage Affairs Limited agrees to sell Products on its Website.

Rewind Vintage Affairs Limited is a company registered in England and Wales (company number 7209307 ) whose registered office address is 65 New Cavendish Street, London, W1G 7LS.. vat number GB 109 9442 00

1 Definitions

In these Terms the following expressions shall have the following meanings:
“Agreement” means any contract entered into pursuant to clause 2 which shall be governed by these Terms.
“Product” means any item of clothing or any accessory sold via the Website. All Products are second-hand items which we sell on behalf of Sellers.
“Seller” means the owner of the Product on whose behalf we sell the Product.
“We” means Rewind Vintage Affairs (and “our” and “us” shall be construed accordingly).
"Website” means our website at www.rewindvintage.co.uk
“You” means the person to whom a Product is sold on these Terms (and “your” shall be construed accordingly).

2 Formation of Contract

2.1 The display of Products and prices on the Website constitutes an invitation to treat. No Agreement shall come into existence unless and until we accept your order. We reserve the right to accept or reject any order in our absolute discretion.
2.2 As and when we accept your order, the Agreement shall be to the exclusion of all other terms, conditions and representations whether written or oral.
2.3 We reserve the right to withdraw any Product displayed on the Website at any time before your order is accepted.
2.4 While we make every effort to describe and display every Product as accurately as possible, you should be aware that the colour and appearance on your PC may be at variance with the actual colour and appearance.

3 Prices, Payment & Delivery

3.1 All prices on the Website are in Pounds Sterling .
3.2 All prices are exclusive of postage and packing which shall be charged at the following rates:-

Rest of the world varies.

3.3 Payment must be made in Pounds Sterling by one of the following debit or credit cards: Visa, Visa Electron, Mastercard, Maestro or Solo.

4 Cancellation

4.1 If for any reason you wish to cancel your order you may do so up to the expiry of 1 working day beginning with the day after the day on which you receive the Product by giving us written notice in accordance with clause 7.3.
4.2 You must return the Product to us at the address above within 2 days of your notice of cancellation. You must pay for the cost of returning the Product. We recommend that you send it by recorded or special delivery. The Product must be returned to us in the same condition as that in which you received it.
4.3 We will refund the price and the original delivery charges to you within 14 days of our receiving the returned Product if the goods are deemed to be faulty or we have made a gross misinterpretation of the condition of the item.

5 Returns Policy

In addition to your right of cancellation under clause 4 and your other statutory rights, we will refund to you the price for the Product less postage and packing on the following conditions:-
5.1 you have contacted us within 24 hours of receiving the Product and received from us a return authorisation ;
5.2 you have paid all postage and packaging for the return of the Product; and
5.3 we have received the Product from you with all security tags still affixed and in the same condition as the Product was sent to you.

We do not accept return for bags and jewellery, and that is strictly for authenticity purposes.

6 Limitation of Liability

6.1 Nothing in these Terms shall exclude or limit our liability for death or personal injury due to negligence.
6.2 To the fullest extent permitted by law, we shall not be liable to you under these Terms for any loss of profits, business, contracts, anticipated savings, wasted expenditure, goodwill or revenue or for any indirect or consequential loss or damage whatsoever howsoever arising out of or in connection with the performance of the Agreement or any breach by us thereof.
6.3 Subject to clause 6.1, our liability under these Terms shall be limited to a sum equivalent to the price paid by you.

7 General

7.1 The privacy of your personal data is important to us and we shall ensure that we comply with all relevant data protection legislation. However, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of information transmitted to the Website and any transmission is at your own risk. Once we receive your information, it will be stored on our secure servers and we will use strict procedures and security features to try to prevent unauthorised access.

7.2 We may send newsletters and other marketing communications to you from time to time. Please let us know if you would prefer not to receive these.
7.3 We shall all times keep your personal data confidential and we shall not, without your prior consent, disclose your personal data to any third party unless required to do so by law.
7.4 Any notice or other communication required to be given under these Terms by you to us shall be in writing and posted to us at the address set out above. We recommend that you use recorded or special delivery. Any notice sent by e-mail shall only be valid if acknowledged by us in writing.
7.5 Any notice or other communication required to be given under these Terms by us to you shall be in writing and sent by post or by e-mail to your last known address.
7.6 We shall not be liable to you for any loss or damage arising as a result of our being prevented from performing our obligations under these Terms by reason of circumstances beyond our reasonable control.
7.7 These Terms and the Agreement are governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the English Courts.

REWIND VINTAGE AFFAIRS recommends that you print out and keep a copy of these terms and conditions for future reference.

These terms and conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.

The Contract Between Us
Any contract for purchases made through the website will be with REWIND VINTAGE AFFAIRS. REWIND VINTAGE AFFAIRS must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.

Once payment has been received REWIND VINTAGE AFFAIRS will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. REWIND VINTAGE AFFAIRS’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

REWIND VINTAGE AFFAIRS is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

General Terms
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.

These terms and conditions only cover the REWIND VINTAGE AFFAIRS website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.

Availability of Goods You Order
If REWIND VINTAGE AFFAIRS has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by REWIND VINTAGE AFFAIRS from your credit card will be re-credited to your account and REWIND VINTAGE AFFAIRS will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. REWIND VINTAGE AFFAIRS will not be obliged to offer any additional compensation for disappointment suffered.

Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.

Changes to This Agreement
REWIND VINTAGE AFFAIRS reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
